Terms and Conditions

1. These Booking Terms and Conditions apply to the booking of Overplay.
2. Please read these Terms carefully and make sure that you understand them, before making a Booking on Our Site. 
3. These Booking Terms and Conditions contain important information concerning participation by you and members of your party and, accordingly, you acknowledge and agree that you shall ensure that all members of your party are aware of and accept these Booking Terms and Conditions.
4. No variation to these Booking Terms and Conditions shall be binding unless agreed in writing by Overplay.

1. No booking shall be deemed to have been accepted unless accepted in writing by Overplay (which shall include Overplay’s ticket agent, Ticket Tailor’s email confirmation of booking).
2. These Booking Terms and Conditions incorporate Overplay’s Privacy Policy and Disclaimer.
3. You must advise Overplay as soon as possible of any mistake in Overplay booking confirmation. Overplay shall use its reasonable endeavors to ensure that you and your party’s participation commences at the time booked and it shall be the responsibility of each participant to ensure that they arrive in sufficient time. Late arrivals may not be permitted to undertake the Activities and no refunds or compensation will be payable in such circumstances.

1. Overplay is a physical activity facility and participation is not without risk. All participants must observe and agree to the safety briefing and sign a waiver, outlining the risks and rules for safe play.
2. Overplay reserves the right to refuse admittance to the facility or to remove a participant from the facility should it deem it necessary to do so. This includes a participant who does not comply with the safety rules and advice system or who is deemed to be under the influence of alcohol or drugs. Our staff have the right to be spoken to with respect and any abusive language or threats will not be tolerated.
3. After the safety briefing participants will not be directly supervised by an instructor.
4. All participants are required to wear grip socks to help prevent slipping and hygiene.
5. All participants must be reasonably fit and healthy and must weigh less than 20 stones.
6. All participants under aged 14 and under must be accompanied to the site by a person aged 18 or above. Prices are on a per person basis and are not depending on age.
7. Anyone who does not meet these requirements will not be allowed to undertake the Activities. It is your responsibility to ensure that all members of your party meet these requirements.
8. If participants have medical concerns they are advised to consult their doctor in advance. Participants will be required to certify that they do not suffer from any medical condition which would make it more likely that they would be involved in any incident which could result in injury to themselves or others. Due to the physical nature of Overplay, pregnant women are unable to take part due to the risks to them and to their unborn child.
9. All participants are required to act responsibly and courteously at all times and to respect other participants. Overplay shall be entitled to prevent any person from undertaking or completing their session in the event it deems the behaviour of any participant unsuitable.
10. Participants must be dressed appropriately and Overplay reserves the right to refuse admittance to the facility to any participant who is not appropriately dressed.
11. No refunds or compensation will be payable by Overplay in the event that any participant is not permitted to, or decides not to, undertake or complete the session for the reasons set out in this clause.
12. All participants age 14 and under must be accompanied on our site by an adult (18+) for the duration of their visit. The adult does not have to take part in activities but must be present in the site, unless the participant is between 90 cm and 100 cm tall, in which case the adult must be a paying participant and supervise the child on the inflatable/rope netting.

1. Overplay sessions can be changed for an alternative date and or time, subject to availability, bookings can be managed through Ticket Tailor. 
2. All purchases are non-refundable. 
3. Overplay shall be entitled to cancel your booking at any time. In the event that Overplay has to cancel your booking it shall use its reasonable endeavours to notify you as soon as possible. Overplay will refund your booking either wholly or in part or will transfer your booking to another date but no other compensation shall be payable.
4. In the event that it proves necessary to close the facility for reasons beyond the control of Overplay, Overplay may, but shall not be obliged to, offer alternative dates or times at which to undertake your booking, in these circumstances refunds will not be issued. In circumstances where your party has commenced participation in the booked session, you shall not be entitled to any refund (in part or in whole).
5. Payments made by debit or credit card will be refunded to the same card or, if the card has subsequently expired, by BACS transfer.
6. Party booking deposits are non-refundable or transferable. 

1. Except as otherwise provided in these Booking Terms and Conditions Overplay shall not be responsible for the loss, or damage, of or to any property or to any person arising from the booking of or participation in the Activities.
2. Parking facilities are available at the site Overplay hires, for terms and conditions of parking users must consult with the car park operator. 
3. Except as otherwise provided in these Booking Terms and Conditions any liability of Overplay shall be limited to the refund of any charges paid to Overplay.
4. Nothing contained in these Booking Terms and Conditions is intended to nor shall limit the liability of Overplay in respect of death or personal injury caused by the negligence of Overplay or of its employees, agents or contractors.

1. If any of these terms are determined to be illegal invalid or otherwise unenforceable it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and continue to be binding and enforceable.
2. Nothing above shall confer on any third party any benefit or the right to enforce any of these Booking Terms and Conditions.
3. These Booking Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales and Overplay and you submit to the exclusive jurisdiction of the courts of England and Wales.
4. Overplay holds no responsibility for any damage or loss of personal clothing or property while on the inflatable or rope netting or within the event site.
5. For the safety and comfort of all visitors, dogs are not allowed inside the park premises. 
   

Overplay use the company Ticket Tailor to provide tickets and payments are made through a payment processor. Payment Processor activities are carried in accordance with the Payment Processor’s own privacy policy.

The details you give us are essential for the processing. By registering on the Site, you agree to provide us with sincere and true information as it concerns you. Communicating false information is contrary to the present general Terms and Conditions.

You have the permanent right to access and rectify all the information that concerns you, in accordance with European texts and national laws in place (article 34 of the law of 6 January 1978). You can at any time make a request to Overplay to find out what personal information we hold concerning you. You may at any time, and by request, modify this information. Cookies record certain information stored on your hard drive. This information enables us to generate statistics based on data from visitors to our site and suggest products that might interest you according to the items that you selected when you previously visited the site. Cookies do not contain any confidential information about you.

All the content on Overplay website (illustrations, texts, names, brand names, images and videos) is the property of Relevention Ltd. Any partial or total reproduction of this content, by any means and on any support, is subject to prior and express authorisation by Overplay. All information, content and files are protected by International law concerning intellectual ownership and copyright. Overplay cannot give you the right to copy, display or distribute content that you do not have the intellectual rights to. All fraudulent use of this content that violates the rights held by a third party constitutes an offence of forgery, which is severely punished under the Intellectual Property Code.

Overplay will not, under any circumstances, be held responsible if a user violates rights held by a third party through their activities on the site.

Any failure of Overplay to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Overplay, and governs your use of the service, superseding any prior agreements (including, but not limited to, any prior versions of the Terms of Service). If any provision of these Terms of Service is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Service will continue in full force and effect.

Any opinions left on the Website by Overplay customers are screened and moderated by Overplay. If the comments infringe on the law or are inappropriate (abusive publicity, defamation, insults, out of context commentary…), Overplay reserves the right to refuse or modify it.
